Please read these Terms carefully before using Amplifx. By tapping "I Agree" at registration, you enter into a binding legal agreement.

1. Acceptance of Terms

Welcome to Amplifx. These Terms of Service ("Terms") govern your access to and use of the Amplifx mobile application (the "App"), including all features, content, and services provided through it. Amplifx is currently operated as a sole proprietorship in the State of California ("we," "us," or "our").

BY TAPPING "I AGREE" AT ACCOUNT REGISTRATION, YOU AFFIRMATIVELY ACCEPT THESE TERMS AND OUR PRIVACY POLICY AND FORM A BINDING LEGAL AGREEMENT. WE RECORD YOUR ACCEPTANCE, INCLUDING THE DATE AND VERSION OF THESE TERMS. IF YOU DO NOT AGREE, DO NOT CREATE AN ACCOUNT OR USE THE APP.

2. Description of Service

Amplifx is an AI-powered meal scoring and general wellness application that:

• Analyzes meal photos and text descriptions to generate an Energy Score (0–100) for general informational and wellness purposes;
• Provides general nutritional suggestions based on your meal data;
• Tracks daily meal history, Energy Score trends, hydration, and streak data;
• Generates daily wellness summaries;
• Suggests grocery ingredients based on your meal history; and
• Provides affiliate links to Amazon for ingredient purchases (see Section 11).

The App is a general consumer wellness tool. It is NOT a medical device, clinical tool, diagnostic instrument, or healthcare service of any kind.

3. Eligibility and Age Requirements

You must be at least 13 years of age to use Amplifx. During signup, you will be asked to enter your age as a whole number. We use your age solely to determine your age band, which governs how advertising is configured for your account. The raw age integer is not stored after your age band is computed.

• Under 13: you will not be permitted to create an account. No data is collected.
• Ages 13–15: you may create an account. Personalized advertising is disabled; only non-personalized ads are served. You represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Ages 16–17: you may create an account. Personalized advertising is permitted. You represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Age 18+: full access with no age-based restrictions.

4. Account Registration and Security

To use Amplifx, you must create an account. You agree to provide accurate registration information, maintain the confidentiality of your password, accept responsibility for all activities under your account, and notify us immediately of any unauthorized access at team@amplifx.app.

5. Free Tier and Usage Limits

• 3 free meal scans per day (both photo and text scans count toward this limit).
• The daily scan counter resets at midnight in your local time zone.
• A 4th or additional daily scan may be unlocked by watching a 30-second rewarded advertisement.
• Viewing your daily wellness summary requires watching a 15-second interstitial advertisement.

6. Health, Medical, and Safety Disclaimers

6.1 Not Medical Advice

AMPLIFX IS NOT A MEDICAL DEVICE, HEALTHCARE SERVICE, CLINICAL TOOL, OR MEDICAL APPLICATION. THE APP, ITS ENERGY SCORES, NUTRITIONAL SUGGESTIONS, DAILY SUMMARIES, AND ALL OTHER CONTENT ARE PROVIDED FOR GENERAL INFORMATIONAL AND WELLNESS PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT OF ANY KIND.

ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE MAKING SIGNIFICANT CHANGES TO YOUR DIET OR LIFESTYLE, PARTICULARLY IF YOU HAVE ANY HEALTH CONDITIONS.

6.2 AI Limitations and Potential Errors

Energy Scores and nutritional suggestions are generated by artificial intelligence and are subject to significant limitations:

• AI analysis may be inaccurate, incomplete, or inconsistent across analyses of identical meals.
• The AI cannot reliably identify all ingredients, allergens, or nutritional components.
• The AI does not account for your individual medical history, health conditions, allergies, intolerances, medications, or specific dietary requirements.
• AI recommendations may conflict with advice from your healthcare provider.

YOU SHOULD NEVER RELY ON AMPLIFX TO IDENTIFY ALLERGENS OR INGREDIENTS THAT COULD CAUSE AN ALLERGIC REACTION, INTOLERANCE RESPONSE, OR HEALTH EMERGENCY. IF YOU HAVE FOOD ALLERGIES OR DIETARY RESTRICTIONS, CONSULT A QUALIFIED PROFESSIONAL.

6.3 Assumption of Risk and Explicit Waiver

BY USING AMPLIFX, YOU EXPRESSLY ACKNOWLEDGE THAT YOU USE THE APP ENTIRELY AT YOUR OWN RISK AND ASSUME FULL AND SOLE RESPONSIBILITY FOR ANY DIETARY CHOICES, LIFESTYLE CHANGES, OR HEALTH DECISIONS YOU MAKE BASED ON INFORMATION FROM THE APP. AMPLIFX AND ITS OWNER ARE NOT RESPONSIBLE FOR ANY HEALTH OUTCOMES, INJURIES, ILLNESS, ALLERGIC REACTIONS, ADVERSE EFFECTS, OR OTHER CONSEQUENCES RESULTING FROM YOUR USE OF OR RELIANCE ON THE APP.

6.4 Special Medical Conditions

IF YOU HAVE ANY OF THE FOLLOWING CONDITIONS, YOU MUST CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE USING THIS APP:

• Diabetes, insulin resistance, or blood-sugar regulation disorders
• Eating disorders, including anorexia nervosa, bulimia nervosa, binge-eating disorder, or ARFID
• Food allergies or intolerances of any kind
• Kidney disease, liver disease, or metabolic disorders
• Cardiovascular disease, high blood pressure, or related conditions
• Pregnancy or breastfeeding
• Any condition requiring a medically supervised diet

6.5 Emergency Situations

AMPLIFX IS NOT AN EMERGENCY SERVICE. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, ALLERGIC REACTION, OR ANY ACUTE HEALTH CRISIS, CALL 911 OR YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY. DO NOT USE THIS APP IN AN EMERGENCY.

7. AI-Powered Analysis

Amplifx uses artificial intelligence powered by Anthropic's Claude model. By using meal-analysis features, you acknowledge that AI-generated content is an approximation only, that the AI cannot account for individual medical conditions or allergies, that your meal data is not used to train AI models, and that you use AI-generated suggestions entirely at your own risk as detailed in Section 6.

8. User Content

When you submit meal photos or text descriptions, you grant us a limited license to process your content solely to provide App services. Meal photos are processed in real time and are not permanently stored on our servers after processing is complete. You retain all ownership rights in your User Content.

9. Prohibited Conduct

You agree not to use the App for any unlawful purpose, circumvent usage restrictions or ad-gating mechanisms, reverse engineer the App, use automated tools or bots, interfere with the App's servers, submit false information including inaccurate age at signup, or facilitate any third party in doing any of the above.

10. Advertising

Amplifx is supported by advertising through Google AdMob. Ad personalization is configured based on the age band associated with your account. Users in the "13–15" age band receive non-personalized ads only; users in the "16–17" and "18+" age bands may receive personalized ads. You may opt out of personalized advertising at any time through your device settings.

11. Amazon Associates Affiliate Program

As an Amazon Associate, Amplifx earns from qualifying purchases. When you tap grocery ingredient links in the App, you will be directed to Amazon.com. We may earn a referral commission on qualifying purchases at no additional cost to you. We are not responsible for any products listed on Amazon, including their availability, pricing, or fitness for your dietary needs.

12. Copyright

The App, its code, design, content, and all materials within it are owned by Amplifx and are protected by United States and international copyright laws. You may not copy, modify, distribute, sell, sublicense, or create derivative works of any part of the App without our prior written permission.

13. Privacy

Your use of Amplifx is governed by our Privacy Policy, incorporated into these Terms by reference. By accepting these Terms, you also accept our Privacy Policy.

14. Third-Party Services

Amplifx integrates with Firebase, Supabase, Anthropic, Google AdMob, Amazon Associates, and EmailJS. Your use of these third-party services is subject to their respective terms and privacy policies.

15. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE EXPRESSLY DISCLAIM ALL WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ENERGY SCORES OR WELLNESS SUGGESTIONS WILL BE ACCURATE OR SUITABLE FOR YOUR INDIVIDUAL CIRCUMSTANCES.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMPLIFX AND ITS OWNER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING ANY HEALTH OUTCOMES, INJURIES, ILLNESS, ALLERGIC REACTIONS, OR ADVERSE HEALTH EFFECTS ARISING FROM USE OF OR RELIANCE ON THE APP OR ITS AI-GENERATED CONTENT.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK AND THAT AMPLIFX SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY HARM TO YOUR HEALTH, SAFETY, OR WELLBEING.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).

17. Indemnification

You agree to indemnify, defend, and hold harmless Amplifx and its owner from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App, your User Content, your violation of these Terms, any dietary changes or health decisions you make based on App content, or your violation of the rights of any third party.

18. Termination

We may suspend or terminate your access to the App at any time without prior notice if we have reason to believe you have violated these Terms. You may terminate your account at any time via Settings > Delete Account. Sections 6, 15, 16, 17, 19, and 20 survive termination.

19. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of California, United States. Any dispute shall be resolved exclusively in the state or federal courts located in California. Before filing any claim, you agree to contact us at team@amplifx.app with a written description of the dispute for informal resolution within 30 days.

20. General Provisions

20.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

20.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amplifx regarding your use of the App.

20.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

20.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent.

20.5 Changes to Terms

For material changes, we will provide at least 15 days' notice through the App and require affirmative re-acceptance at your next login.
